Assaults

A conviction for a crime involving assault can result in jail or prison time, fines and/or probation.  For example:

  • Aggravated Assault – causing Serious Bodily Injury (includes substantial risk of death) or using or exhibiting a Deadly Weapon
    • 2nd Degree Felony (2 years to 20 years in prison and up to $10,000.00 fine) or
    • 1st Degree Felony (5 years to 99 years in prison and up to $10,000.00 fine) – if deadly weapon is used and serious bodily injury results to a family member or if involves peace officer
  • Assault - causing Bodily Injury (includes feeling physical pain)
    • Class A misdemeanor (up to 1 year in jail and up to $4,000 fine)
  • Assault of Family Member – causing Bodily Injury
    • Class A misdemeanor (up to 1 year in jail and up to $4,000 fine)
  • Assault of Family Membercausing Bodily Injury – with previous conviction for Assault of Family Member
    • 3rd Degree Felony (2 years to 10 years in prison and up to $10,000 fine)
